Sendit Terms of Use
These Terms of Use govern your use of sendit.health (the "Site"), operated by Send-it Healthcare Inc. ("Sendit," "we," "us"). By using the Site you agree to these terms. If you do not agree, please do not use the Site.
These terms cover the Site only. Use of Sendit's products is governed by separate agreements:
Sendit Pulse is governed by the Sendit Pulse Terms of Service: https://app.senditpulse.health/legal/privacy-policy
Sendit Gigs is governed by the Sendit Gigs Terms of Service: https://www.senditgigs.com/terms-of-service/
If there is a conflict between these Terms of Use and a product agreement, the product agreement controls for that product.
1. What the Site is for
The Site provides information about Sendit and its products, and lets you contact us or request a demo. Content on the Site is for general information. It is not legal, financial, clinical, or professional advice, and it does not create a contract for any product or service. Product terms are agreed separately.
2. Acceptable use
You agree not to use the Site in any way that is unlawful, that interferes with the Site or with anyone else's use of it, or that attempts to gain unauthorized access to any part of the Site or its systems. You agree not to scrape, copy, or harvest content or data from the Site by automated means, and not to submit false or misleading information through any form on the Site.
3. Our content
The Site and everything on it, including text, graphics, logos, images, and software, is owned by Sendit or its licensors and is protected by copyright, trademark, and other laws. Sendit, Sendit Pulse, and Sendit Gigs are trademarks of Send-it Healthcare Inc. You may view and print pages from the Site for your own reference. You may not otherwise reproduce, distribute, or create derivative works from Site content without our written permission.
4. Information you submit
Information you submit through the Site is handled according to our Privacy Policy. By submitting an enquiry, you agree that we may contact you about it. Do not submit patient information or other protected health information through the Site.
5. Third-party sites and services
The Site links to other websites and services, including the Sendit Pulse and Sendit Gigs sites, our scheduling provider, and social networks. We do not control those sites and are not responsible for their content or practices. Links are provided for convenience and do not imply endorsement.
6. No warranties
The Site is provided "as is" and "as available." To the fullest extent permitted by law, Sendit disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete or current.
7. Limitation of liability
To the fullest extent permitted by law, Sendit and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred US dollars.
8. Changes
We may change the Site or these terms at any time. Changes to these terms take effect when posted, and the effective date at the top will be updated. Your continued use of the Site after a change means you accept the updated terms.
9. Governing law
These terms are governed by the laws of the State of Tennessee, without regard to its conflict of law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Davidson County, Tennessee, and you consent to the jurisdiction of those courts.
